Compliance requirements
The bidder must confirm that neither the bidder nor the members of its management, administrative or supervisory bodies, nor its proxies or other authorised representatives, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or other exclusion grounds listed in the ESPD, and that no ongoing exclusion period applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD also requires answers on payment of taxes and social security contributions and on the other exclusion-ground questions. The exact exclusion grounds and any remediation conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The compliance conditions require a joint-bid power of attorney if the bid is submitted jointly. The bidder must confirm that the bid complies with all conditions set out in the procurement documents and that the bid is not conditional. The bidder must also confirm that subcontractors or suppliers representing more than 10% of the contract value will not include Russian nationals, residents or Russian companies, or entities controlled by them or acting on their instructions. The service description for the targeted search service, the CVs of the recruitment consultants, the CV of the market mapper, and, where applicable, the justification for additional team members must be submitted in accordance with the annexes to the tender documents. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
