Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing; conviction for enabling illegal employment of a foreign national or violating the conditions for employing a foreign national; conviction for illegal use of child labour or trafficking in human beings; tax debt or social security contribution debt. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached a previous public contract, or if it has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurements, the reference numbers. Upon request by the contracting authority, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain this information from public or its own databases without major effort. At the time of submitting the bid, the bidder must have a person in charge of electrical works with a valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who holds the relevant certificate and has been entered into Elektrilevi’s partner portal before the opening of bids. The bidder must also have a person with valid switching rights for switching operations in the 0.22–20 kV network and a person designated as responsible for work operations, both entered into the EPP environment before bid opening. The bidder must provide the names and contact details of the contract signatory(ies) and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must include the price table in the prescribed form and all unit price fields must be completed. The bid must comply with all tender document requirements, and alternative or conditional bids are not permitted.
