Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or other exclusion grounds listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that neither it nor persons acting on its behalf have committed corrupt acts in this procurement procedure. In addition, the bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act is used in performance of the contract.
Qualification criteria and exclusion grounds
The bidder must have achieved annual net turnover of at least EUR 200,000 in each of the last two financial years completed by the start of the procurement procedure. The bidder must provide the data in the ESPD and, if necessary, an extract from the annual report or other proof if the information is not publicly available to the contracting authority. For technical capacity, the bidder must have properly performed at least one design contract within the 36 months preceding the start of the procurement procedure, covering a building with at least 1,000 m2 of enclosed net floor area and intended for a care institution, hospital, health facility or similar use, at least at the preliminary design stage. The bidder must provide the contract description, value, dates, client details and contact details. The contract performance team must include a project manager and specialists whose qualifications meet the requirements set out in clauses 2.1 and 2.2–2.10 of the design contract; CVs must be submitted on the required forms. The tender must comply with the procurement documents, be unconditional, and the tender price must be submitted in the prescribed structure. In the case of a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. If equivalence is used, it must be explained and supporting evidence must be provided.
