Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply. A foreign bidder must provide a criminal record certificate or an equivalent document regarding the circumstances referred to in Section 95(1)(1)–(3), and a certificate from the competent authority confirming the absence of the circumstances referred to in Section 95(1)(4). The contracting authority has also set a domestic-law restriction based on the bidder’s country of establishment or residence; the bidder must confirm whether this restriction applies and, where relevant, whether the information is electronically available.
Qualification criteria and exclusion grounds
For Lot 1, the bidder’s total turnover for the last two completed financial years must be at least EUR 200,000; for Lot 2, it must be at least EUR 88,000. The bidder must provide figures for 2023 and 2024 and, upon request by the contracting authority, an extract from the last two annual accounts or a certificate from the competent authority in the bidder’s country of establishment. If the data for the last completed financial year are not yet publicly available, the bidder must submit an extract showing compliance with the turnover requirement. The bid must comply with all tender document requirements, be unconditional, and, where necessary, equivalence must be explained and supporting evidence provided. The bidder must submit the bid price in the required structure and include the required pricing form. For Lot 1, a menu description with quantities must be submitted; for Lot 2, descriptions with quantities of cakes, kringel, semlor and sandwich cakes must be submitted. The products must be packaged so that they remain presentable during transport and, where needed, can pass through security screening equipment. Food transport must comply with hygiene rules, and materials and articles intended to come into contact with food must meet the requirements of the Food Act. The goods must be delivered by the bidder’s own transport at the agreed time. The bidder must be able, if requested, to offer gluten-free, sugar-free, lactose-free or vegan confectionery products. The bidder must also describe any trade secrets contained in the bid or confirm that the bid contains no trade secrets.
