Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or human trafficking, the commission of a terrorist act or other terrorism-related offences, or any other exclusion ground stated in the contract notice. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact list of exclusion grounds and any remediation conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 338,000. Joint bidders may aggregate turnover. The bidder must provide turnover data in the ESPD and, upon request, an extract from the latest annual accounts or other evidence if the data are not publicly available. For technical and professional capacity, the bidder must submit a list of road construction contracts for public roads completed within the last 60 months and, upon request, client confirmations that the works were performed properly. As compliance requirements, the bidder must confirm acceptance of all contract notice and procurement document terms, submit a bid only for the requested matters, not involve a subcontractor subject to replacement, correctly identify business secrets, and submit a fully completed bill of quantities. In the case of a joint bid, a power of attorney and a separate ESPD for each joint bidder are required.
