Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies, its procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the tender. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The machine-readable notice did not include all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must confirm that the tender complies with the requirements set out in the procurement documents and that no conditional tender has been submitted. In the case of a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. If the bidder relies on equivalence, it must be explained and evidence of equivalence must be provided. The bidder must also confirm that the tender price has been submitted in the required structure and that zero or negative prices are not used. In addition, the bidder must confirm, where applicable, that any trade secret has been marked and justified and that the bidder is established in Estonia, another EU Member State, another EEA contracting state or a WTO Government Procurement Agreement country.
