Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, as well as the other grounds listed in the ESPD. The bidder, or members of its management, administrative or supervisory body, procurators or other persons with authority to represent it, must not have been finally convicted of these offences within the last 5 years if the disqualification period is still in force. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. A foreign bidder must submit a certified extract from the register of its country of establishment, together with an Estonian translation; for an Estonian bidder, the contracting authority checks the registration itself. As a financial and economic capacity requirement, the bidder’s average net turnover from natural gas sales or realisation over the last 3 completed financial years (2023–2025) must be at least EUR 180,000 per year. The bid must include the relevant form or confirmation regarding this turnover. If the bidder relies on the resources of another company, both parties’ confirmations of joint responsibility must be submitted, together with that company’s ESPD and other required documents. A joint bidder must submit a power of attorney for the joint bid. The bid must remain valid for at least 1 month from the deadline for submission of tenders. The bidder must have a valid agreement with Elering AS for open supply and balancing management; if this is visible in the public system, the contract does not need to be submitted separately. The machine-readable notice did not include other precise qualification or compliance requirements; they must be checked in the tender documents.
