Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply. These include, among other things, convictions for certain offences, enabling illegal work in Estonia or breaching wage requirements, offences related to child labour or human trafficking, national tax and social security debts, and breaches of sanctions. If the bidder relies on a subcontractor, the contracting authority may also check the subcontractor’s exclusion grounds.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if this is required under that country’s law, and must provide evidence of registration where required. An Estonian bidder does not need to submit a business register extract. The bidder and/or its subcontractor must have properly performed at least 1 similar contract in the 60 months before the start of the procurement, where the subject was medium- or high-voltage cable installation and/or cable route construction, including cable installation and connection. A list of contracts must be submitted with the contract name, short description, performance period and the other contracting party. The bidder and/or its subcontractor must have qualified responsible persons for the works, including a person in charge of electrical works with at least an A-class competence certificate (or equivalent or better). Copies of documents proving competence must be submitted; a foreign bidder must submit copies of the documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. If the bidder relies on another undertaking’s resources, the subcontractor must be added to the subcontractors table in the register.
