Compliance requirements

The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence, money laundering or financing of terrorism. A bidder is also excluded if it has been convicted of enabling the employment of a foreign national staying in the country illegally, violating the conditions for employing a foreign national in Estonia, or unlawful use of child labour or trafficking in human beings. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. In addition, the contracting authority may exclude a bidder that has seriously or repeatedly breached an earlier public contract, or has submitted false information about qualification or failed to provide requested information or documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided unless the authority can obtain the information itself from public or its own databases without significant cost. As compliance requirements, the bid must comply with the tender documents, include the required price table, and all unit price fields must be completed. The bidder must have a person managing electrical works with valid A-competence or at least level 6 qualification under the Vocational Qualifications Act, who has the relevant certificate at the time of submission and is entered in Elektrilevi’s partner portal before bid opening. The bidder must also have a worker with valid switching rights for 0.22–20 kV network works and a person responsible for the work operation, both entered in the EPP system before bid opening. The bidder must provide the names and contact details of the contract signatory or signatories and the contact person for contract performance matters, and a power of attorney if representation does not arise from the articles of association. If the bidder does not choose the contracting authority’s standard payment term, a 95-calendar-day payment term applies under the factoring programme. The bidder must identify business secrets, but may not mark the bid price or other indicators relevant to award criteria as business secrets. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or Belarus, and that materials, equipment and goods used in the works are not produced in or originating from those countries; the contracting authority may request certificates of origin.
