Compliance requirements

The contracting authority will exclude a bidder if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence, money laundering or financing of terrorism. A bidder is also excluded if it has been convicted of enabling the employment of a foreign national staying in the country without legal basis, or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory minimum wage, as well as for illegal use of child labour or trafficking in human beings. Exclusion also applies where the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or persistent breach of an earlier public contract, or if the bidder has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, and at least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurements, the reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed, unless it can obtain the information from public or other databases without significant cost. The tender must comply with all tender document requirements and include a price table, with all unit price fields completed. The bidder must have a worker with valid switching rights for work in the 0.22–20 kV electricity network; if only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. There must also be a person responsible for the work operation with valid rights, entered into Elektrilevi’s partner portal before the opening of tenders. The bidder must have a person managing electrical works with valid A-competence or at least level 6 qualification under the Occupational Qualifications Act, together with the relevant certificate at the time of tender submission. The bidder must provide the names, job titles and contact details of the contract signatory and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm that only materials, equipment and goods not produced in or originating from the Russian Federation or Belarus will be used in the works, and the contracting authority may request certificates of origin. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or Belarus. The machine-readable notice did not include more precise compliance or qualification requirements in other respects; these should be checked in the tender documents.
