Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–3 and 5 of the Public Procurement Act apply, subject to the statutory exceptions. The bidder must not be bankrupt or in liquidation, no bankruptcy or liquidation proceedings may have been initiated against it, and its business must not be suspended. The bidder must not have debts for state taxes, fees or environmental charges, or debts for tax or social security contributions. The bidder must also confirm that its employees' average salary during the reference period was above 70% of the average salary for the same period in the relevant sector and provide a Tax and Customs Board extract or an equivalent certificate from a foreign competent authority. The bidder must not be a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In the case of a joint bid, the exclusion grounds are checked for each joint bidder separately.
The machine-readable notice did not include precise exclusion grounds beyond these confirmations; the official tender documents must be checked for the full wording and verification procedure if needed. The bidder must also note that the conditions and control procedure are described in the invitation to tender.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business notice for electrical works covering the construction, including installation, of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document.
The bidder's net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value, excluding VAT. The estimated contract value is the estimated value of the apartment building reconstruction works with the highest value.
The bidder must have carried out at least one equivalent construction project within the 60 months before the procurement was announced, with a value of at least half of the estimated contract value excluding VAT. An equivalent project means a building erection, extension, or full-building reconstruction carried out as the main contractor, including at least structural and external envelope works, mechanical ventilation with heat recovery, and a new heating system. The bidder must provide the project name, building details, execution period, value excluding VAT, and evidence such as a handover certificate or a reference to the building register use notice or occupancy permit.
The bidder's team must include a project manager with at least level 6 construction engineer qualification specialising in building construction or level 6 construction manager qualification specialising in general building works; an on-site manager with at least level 5 construction site manager qualification specialising in general building works; a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer competence or level 6 construction manager qualification specialising in indoor climate systems; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer competence or level 6 construction manager qualification specialising in internal or associated water supply and sewerage systems; and, for electrical works, a person with at least a B-class competence certificate or level 6 electrical engineer qualification in consumer electrical installations. Foreign bidders may use equivalent competence. The relevant persons must be involved in carrying out the works, and their names and certificate numbers must be provided.
The bidder must also accept the requirement to provide a performance security equal to 5% of the contract value by the contract date or within 10 calendar days after signing the contract. The security must remain valid throughout the construction period and may also be provided by depositing the amount to the beneficiary's bank account or a notary account under the stated conditions.
If the bidder relies on team members who are not its employees and are not listed in a public register as its competent persons, written consent from each such person must be submitted. If the bid is submitted by an authorised representative, a power of attorney must be provided. If the bid contains trade secrets, the bidder must identify them and explain why they are trade secrets. The bid must be unconditional and comply with all tender documents. Equivalent solutions must be supported by evidence.
