Compliance requirements
The bidder must confirm that neither it nor any member of its administrative, management or supervisory body, nor any person with power to represent, decide on behalf of, or control it, has been finally convicted within the last five years for participation in a criminal organisation. If such a ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed for the procurement. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register in accordance with the law of its country of establishment; a bidder established in Estonia must be registered in the commercial register, and a bidder established abroad must provide proof of registration if this is required in its country of establishment. Only bidders from countries permitted under § 3(2) of the Public Procurement Act may participate. According to the compliance requirements, the offered laptops, desktop computers and tablets must comply with the technical specification. The bid must include the names and models of all offered devices, the full manufacturer specification, a publicly available product page or a file version of it if the page is not online, and evidence of the required benchmark results with screenshots not older than 10 days. The bidder must be the official representative or reseller of the offered devices in Estonia and provide a written confirmation from the manufacturer with contact details. Contact details of the companies providing maintenance and repair must also be submitted. The contracting authority must be able to test the devices at its premises within 10 working days after the request is made. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
