Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in § 95(1) points 1–5 of the Public Procurement Act apply to it. These include convictions for offences related to participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of labour, human trafficking, tax debts, or breaches of sanctions. If the bidder cannot make this confirmation, it may be excluded from the procurement procedure.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional capability by having performed at least one contract equivalent to the subject of the tender, related to the repair service of railway special tools, within the 36 months before the start of the procurement. A list of the most important contracts must be submitted, including their value, dates and the other contracting parties, using the form ‘List of contracts’. In addition, the bidder must submit a tender that complies with the tender documents, complete the price form, and confirm that the tender meets the requirements. Conditional tenders are not allowed. The bidder must also confirm that it agrees to conclude the contract without specific quantities and indicate any trade secrets in the tender, if applicable.
