Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply, including convictions for participation in a criminal organisation, corruption, money laundering, terrorism, child labour or human trafficking, as well as tax debt or sanctions-related violations. The bidder must also confirm that none of the exclusion grounds described in Section 95(4) apply, such as breaches of environmental, social or labour law obligations, bankruptcy or liquidation, professional misconduct, anti-competitive agreements, conflicts of interest, false information, or tax offences. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The tender must be submitted by the bidder’s legal representative or an authorised representative. If the bid is submitted by an authorised representative, a power of attorney must be attached upon the contracting authority’s request; a bidder registered abroad must provide proof of authority upon request. In the case of a joint bid, the joint bidders must appoint an authorised representative and attach a joint power of attorney. The bidder must confirm that the bid complies with the tender documents, that no conditional bid has been submitted, and that the bid price has been entered in the required structure. If equivalent solutions are used, equivalence must be explained and supporting evidence attached. The bidder must also provide the required trade secret explanation or confirm that the bid contains no trade secrets. The service point may not be more than 6 km from the contracting authority’s distribution point; the distance is measured along the road using Google Maps. If goods are being offered, the bidder must confirm that the goods are not subject to international sanctions and do not originate from sanctioned areas. The bidder must also confirm that subcontractors and suppliers linked to the Russian Federation will not be engaged for more than 10% of the contract value.
