Compliance requirements

The bidder must not be subject to the mandatory exclusion grounds, including conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; enabling illegal employment of a foreign national or violating wage-related employment rules; illegal use of child labour or human trafficking; or tax, fee, environmental charge, social security or tax debt. The contracting authority may also exclude a bidder that has seriously or repeatedly breached a previous public contract or has provided false information about qualification or failed to submit required information and documents. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and public procurement reference numbers where applicable. On request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information from public or its own databases without significant cost. The tender must comply with the procurement documents and include the required price table. The team must include a person with valid switching authorisations who has been entered into Elektrilevi’s partner portal before the opening of tenders; for low-voltage works at least MV switching authorisations are required, and in other cases both MV and HV switching authorisations are required. There must also be a person appointed as responsible for the work operation, entered into the EPP before the deadline for submitting tenders. The electrical works lead must hold valid A-competence or at least level 6 qualification under the Vocational Qualifications Act, have the relevant certificate, and also be entered into the EPP before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory(ies) and the contact person, and a power of attorney if needed. In the case of a joint tender, a joint bidders’ power of attorney must be attached. The machine-readable notice did not include any further precise qualification or compliance requirements; the rest must be checked in the tender documents.
