Compliance requirements
The bidder must confirm that no exclusion grounds apply. The contracting authority may exclude a bidder, for example, if there is a dispute with an Eesti Energia group company over performance of a previous contract, an outstanding payable claim, a serious breach of a previous contract, failure to comply with ethics or occupational health and safety requirements, a conviction for corruption, fraud, terrorism or money laundering, submission of false information, withdrawal of the bid after the deadline, refusal to sign the contract after the bid has been declared successful, or failure to submit requested information and documents. Exclusion may also apply if the bidder is not established in the required countries or if other justified grounds exist.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register or another equivalent register in its country of establishment, if required by that country’s law. For bidders established in Estonia, the contracting authority checks the data itself; a foreign bidder must submit a copy of a valid registration certificate. To prove technical and professional capacity, the bidder and/or its subcontractor must have completed at least one similar contract in the last 36 months before the start of the procurement, covering the installation and repair of fiberglass pipelines and tanks. The bidder must also submit a list of major contracts with information on value, dates and the other contracting parties, together with confirmation that the contracts were performed properly and the work was carried out in accordance with good practice. The bid must be unconditional, the bid price must be entered on the designated e-RHR price sheet, and in the case of a joint bid or subcontracting, the relevant power of attorney or subcontractor list must be provided.
