Compliance requirements
The bidder must be excluded if any of the exclusion grounds in Section 95(1)(1)–(5) of the Public Procurement Act apply to it or its representative: conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; conviction for enabling illegal employment of a foreign national or violating wage requirements; conviction for illegal use of child labour or human trafficking; tax, fee or social security contribution arrears; or a breach of an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of its country of establishment, if required by the laws of that country, and must provide a copy of the document proving registration when required. An Estonian bidder does not need to submit a commercial register extract. The bidder and/or its subcontractor must have properly performed at least 1 similar contract within the last 60 months before the start of the procurement, where the subject was installation, reconstruction or modernisation of security systems, including installation or upgrading of video surveillance, access control or perimeter surveillance systems. Form 2 and a list of major contracts must be submitted, together with a confirmation that the works were carried out in accordance with the contract and good practice. For the performance of the works, qualified responsible persons must be available: a responsible person for installation works with at least the professional qualification “Security Systems Technician, Level 4” and a person managing electrical works with at least a Class B competence certificate. Form 3 and copies of documents proving competence must be submitted; a foreign bidder may submit equivalent documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority. The tender must comply with the procurement documents, be submitted in the required structure according to Form 1, and documents confirming the type of the offered equipment, a list of technical characteristics or equipment passports must be provided. In the case of a joint tender, a power of attorney for the joint bidders must be attached. If equivalent solutions are used, equivalence must be explained and supporting evidence must be attached.
