Compliance requirements
The bidder must be excluded from the procurement procedure if any of the grounds listed in Section 95(1), points 1–5 of the Public Procurement Act apply to the bidder or its representative: participation in a criminal organisation, corruption, fraud, offences related to terrorism, violations concerning the employment of illegally staying foreign nationals, offences related to child labour or human trafficking, tax debt, or breach of sanctions. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register or another equivalent register of its country of establishment, if required by the laws of that country. For bidders registered in Estonia, the contracting authority will check the data itself; a foreign bidder must submit a copy of a valid registration certificate.
The bidder and/or its subcontractor must have performed at least one similar contract related to roof repair within the last 60 months before the start of the procurement. Form 2, "List of contracts", must be submitted together with information on the contract dates and the other contracting parties, as well as a confirmation that the contracts were performed properly.
A qualified person responsible for the works must be available: a person managing construction works who holds at least a level 6 professional certificate as a construction engineer (initial qualification is not sufficient) or at least a level 6 professional certificate as a construction manager. A foreign bidder must submit equivalent qualification and competence evidence from its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person's qualification and competence.
