Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under § 95(1) points 1–5 of the Public Procurement Act apply to the bidder or to persons connected with its representation. These grounds include participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of labour or breach of rules on employing foreign nationals, illegal use of child labour or human trafficking, tax debt, and breach of international or Government sanctions. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder and/or its subcontractor must have completed at least two contracts for works similar to the subject of the procurement within the 36 months preceding the start of the procurement. A list of the most important contracts must be submitted, showing their value, dates and the other contracting parties, using the form ‘List of contracts’. The bid must comply with the procurement documents, and conditional bids are not allowed. If the bid is joint, an authorised representative must be appointed and a power of attorney for the joint bidders must be attached. The bidder must also submit a description of the works to be performed together with the list of equipment and tools to be used, the expected schedule, and the completed price form.
