Compliance requirements

The bidder must not have any exclusion grounds under Section 95(1) of the Public Procurement Act. This means that neither the company nor its management body members may have been convicted, for example, of participation in a criminal organisation, corruption, fraud, a terrorist act, money laundering, financing of terrorism, child labour offences or human trafficking. There must also be no tax debt and no sanctions breach. In a joint bid, the declarations must be submitted separately for each joint bidder. If the bidder relies on another company’s resources, the same declarations must also be submitted for that company. The contracting authority has also included a domestic restriction requiring verification of whether the company’s place of residence or establishment meets the condition set out in the procurement documents.

Qualification criteria and exclusion grounds

The bidder’s total turnover for each of the last three financial years ended by the time the procurement started must be at least EUR 220,000 per year. If requested, an extract from the annual accounts or another appropriate proof must be provided. If the bidder uses another company’s resources, declarations of no exclusion grounds must also be provided for that company. The bidder must confirm that the tender complies with the procurement documents, that conditional tenders are not allowed, and that the tender price is submitted in the required table and structure. The tender must include all costs, unit prices and the total price both excluding VAT and including VAT; negative values are not allowed. A project manager must be involved in contract performance. The project manager must have, within the last five years, experience of managing at least two conservation or restoration works on cultural monuments as the contractor’s project manager and must also have managed general construction works. The project manager must hold a construction engineer professional qualification or an equivalent EKR/EQF qualification at least at level 6. The bidder must submit the project manager’s CV. By the time the contract is signed, the bidder must have a business activity notice or equivalent registration/permit for the activity area “Heritage conservation” with the exact classification “Conservation and restoration of a building located on a monument or a World Heritage site”. If the bidder is not established in Estonia, a certificate from the competent authority of the bidder’s country of establishment confirming the registration or permit must be submitted. The tender also requires confirmation of a joint bid power of attorney, clarification and evidence of equivalence where applicable, non-involvement of a subcontractor that would have to be replaced, confirmation that the offered goods are not subject to international sanctions, and disclosure of business secrets if the tender contains any.
