Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorism-related offences, child labour or human trafficking, or any other exclusion grounds listed in the ESPD. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that no sanctions-related prohibition applies and that it does not use subcontractors or suppliers for more than 10% of the contract value if they are Russian citizens, residents or companies established in the Russian Federation, entities more than 50% owned by such persons or entities, or persons acting on their instructions. It must also be confirmed that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
Qualification criteria and exclusion grounds
The bidder’s net annual turnover for each of the last three completed financial years before the start of the procurement must be at least EUR 20,000,000 per year excluding VAT. The turnover must be stated in the ESPD, and supporting documents must be provided on request by the contracting authority. To prove technical capability, the bidder must have properly performed at least 2 contracts in the last 60 months before the start of the procurement, under which at least 24 automated border control gates were successfully installed in total and integrations were carried out with two different national border information systems. For the references, the bidder must provide the contract award and performance dates, a short description, the client details and contact information. The bid must also include Annex 2 technical description, a project plan and a document proving the manufacturer’s representation rights or a link to the manufacturer’s website. If the bid is joint, a joint bidders’ power of attorney must be submitted. If the solution does not meet all mandatory requirements, the bid will be rejected.
