Compliance requirements
The bidder must be excluded from the procurement procedure if the bidder, or a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing. Exclusion also applies where there has been a conviction for enabling illegal employment, violating the conditions for employing a foreign national, or illegal use of child labour, as well as where the bidder has tax debts, public charges or environmental charge debts. In addition, the contracting authority may exclude a bidder that has seriously breached a previous public contract or has submitted false information about qualification or failed to submit required documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, including at least one contract with a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, showing the performance period, the other contracting party’s details and, in the case of public procurement, the reference numbers. The contracting authority may request evidence of proper performance. The bid must comply with the tender documents and include the required price table. The bidder must have a worker with valid switching authorisations for work in the 0.22–20 kV electricity network; if only low-voltage works are procured, at least low-voltage switching authorisations are sufficient. The bidder must also have a person designated as responsible for the work operation with valid rights, registered in the EPP environment before bid opening. In addition, the bidder must have a person managing electrical works who holds valid A-level competence or at least level 6 qualification within the meaning of the Occupational Qualifications Act, together with the relevant certificate at the time of bid submission. The signatory of the contract and the contact person must be named, and if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm whether it chooses the contracting authority’s standard payment term if it does not join the factoring programme. The bidder must indicate any business secret in the bid and justify that designation. The bidder must also confirm that it is not established in the Russian Federation or the Republic of Belarus and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus.
