Compliance requirements

The bidder is excluded if the bidder or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder has been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of child labour or human trafficking. Exclusion also applies if the bidder has tax, fee or environmental charge arrears, or social security contribution arrears, or if awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must confirm that no exclusion grounds apply. A foreign bidder must also submit the relevant evidence from its home-country register or competent authority; for an Estonian bidder, the contracting authority checks part of the information itself.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register or another equivalent register of its home country; a foreign bidder must submit a copy of a valid registration certificate if such registration is required in its country. The bidder must prove prior experience in providing Owner's Engineer or Consulting Engineer services: at least 3 successfully completed projects in the last 36 months for thermal power plants, combined heat and power plants or waste-to-energy plants with a thermal capacity of at least 100 MWth. In each referenced project, the facility had to use a DCS system based on Emerson, Siemens, ABB, Yokogawa, Honeywell or another equivalent industrial automation platform, and at least one project had to involve DCS replacement, modernisation, migration or integration in an operating plant. To prove experience, the bidder must submit Form 1 with an overview of the contract(s), location, scope of work, dates and the other contracting parties. The bid must also include a team description and CVs of the key experts; the team must include at least DCS/automation for power plants and cybersecurity competence, and the CVs must show education, professional qualification, relevant experience and suitability for the role. The bid must comply with all tender document requirements, be unconditional, and the bid price must be submitted in the required structure. The consulting service must be independent, objective and free of conflicts of interest; the bidder must also confirm that the advice is vendor-neutral and independent of DCS platform suppliers.
