Compliance requirements
The contracting authority will exclude a bidder or applicant if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for, or control the company, has been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, a terrorist offence or related incitement, aiding or attempt, money laundering, or terrorist financing. Exclusion also applies if such a person has been convicted of enabling the employment of a foreign national staying in the country illegally, or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate. The same applies to convictions for illegal use of child labour or human trafficking. A bidder is also excluded if it has tax, duty or environmental charge arrears under Estonian law, or tax or social security contribution arrears under the law of its country of establishment. Exclusion applies if awarding the contract would breach an international sanction or a Government of the Republic sanction under the International Sanctions Act. The bidder must confirm the absence of these grounds in a free-form document.
Qualification criteria and exclusion grounds
The bidder must demonstrate financial capacity in at least one of two ways. First, the bidder must have at least EUR 100,000 in free funds available for contract performance; this must be proven by a bank statement confirming the availability of free funds on the bidder’s account. Second, the bidder may prove that its equity as of 31 March 2026 is at least 25% of the balance sheet total, but not less than EUR 100,000; for this, the bidder must submit a free-form statement describing compliance with the requirement together with a balance sheet signed by the bidder’s legal representative as of 31 March 2026. The bidder must name an authorised representative who represents the bidder and provides clarifications if needed, and a responsible representative for contract performance, i.e. the contractor’s project manager. The bidder must have experience gained during the previous 60 months in constructing gravity sewer and water pipes in a single trench under an asphalt-paved street over a minimum length of 150 metres, where the outer diameter of the gravity pipe is at least De 200 mm and the outer diameter of the water pipe is at least De 110 mm. When submitting the bid, the bidder must use the required bid form and confirm that the bid complies with the conditions set out in the procurement documents; conditional bids are not allowed.
