Compliance requirements
The contracting authority will exclude a bidder if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, decide for, or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence or related offences, money laundering, or financing terrorism. Exclusion also applies if the bidder or its representative has been convicted of enabling the employment of a foreign national staying in the country illegally, violating the conditions for employing a foreign national in Estonia, including paying wages below the statutory minimum, or offences involving illegal use of child labour or human trafficking. The bidder will also be excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. In addition, the bidder will be excluded if concluding the contract with it would breach an international sanction or a sanction of the Government of the Republic. The bidder must submit a confirmation that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must prove its ability to perform the contract in at least one of two ways. First, the bidder must have access to financial resources of at least EUR 100,000 for contract performance; this must be evidenced by a bank statement confirming that the bidder has free funds of at least EUR 100,000 on its account. Second, the bidder’s equity as at 31.03.2026 must be at least 25% of the balance sheet total, but not less than EUR 100,000; this must be evidenced by a free-form statement describing compliance with the requirement and accompanied by a balance sheet signed by the bidder’s legal representative as at 31.03.2026. The bidder must have, within the previous 60 months, experience in constructing self-flow sewer and water pipes in a single trench under an asphalt-paved street over a minimum length of 150 metres, where the self-flow pipe outer diameter was at least De 200 mm and the water pipe outer diameter at least De 110 mm. The bid must name the bidder’s authorised representative and the responsible representative during contract performance, i.e. the contractor’s project manager. Contact details for the representatives and a free-form document proving the pipeline construction experience must also be submitted. By submitting the bid, the bidder must confirm that the bid complies with the conditions set out in the procurement documents, and conditional bids are not allowed. The prescribed bid price form must be used.
