Compliance requirements

The bidder must confirm that neither the bidder nor a joint bidder has any exclusion grounds under clauses 1–3 and 5 of Section 95(1) of the Public Procurement Act, that they are not bankrupt, in liquidation or in a similar situation, that they have no debt for state taxes, fees or social security contributions, and that the bidder’s employees’ average wage during the reference period was above 70% of the average wage in the same period in the relevant field for the contract. The bidder must also confirm that it is not a related person to the beneficiary’s technical consultant.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or adjacent water supply or sewerage systems; for electrical works, the bidder must also have the relevant registration for construction and installation of electrical installations. For a foreign bidder, the registration requirement does not apply, but equivalent proof of competence must be provided. The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT; the exact amount must be entered to the nearest euro. By the time the contract is signed, or within 10 calendar days after signature, the bidder must be able to provide a construction-period guarantee worth 5% of the contract price; the guarantee must remain valid for the entire construction period and may also be provided by depositing the corresponding amount into the beneficiary’s or a notary’s account, provided the beneficiary remains the entitled party throughout the period. Within the previous 60 months, the bidder must have carried out at least one comparable construction project as the main contractor with a value of at least half of the estimated contract value; the comparable work must include construction or reconstruction of the building’s load-bearing and external envelope structures, forced ventilation with heat recovery, and a new heating system plus water supply and sewerage system. Proof must be provided by a handover-acceptance certificate signed by the client and contractor or by building register data showing the completion through a use notice or use permit. The team must include a project manager, site manager, ventilation and heating specialist, water supply and sewerage specialist, and a person performing electrical works; for each role, the name and professional certificate number must be provided, and the specialists must participate until completion of the works. The bidder must have a quality management system in construction works compliant with EVS-EN ISO 9001 or equivalent and an environmental management system compliant with EVS-EN ISO 14001 or equivalent; valid documents must be submitted.
