Compliance requirements

The bidder must confirm that none of the exclusion grounds under section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been initiated against it, and its business has not been suspended or is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee, environmental charge, social security or similar public-law debt under the law of its country of establishment. The bidder must confirm that its average employee salary during the reference period was more than 70% of the average salary in the relevant sector for the same period. The reference period is six calendar months, ending with the penultimate calendar month before the procurement procedure started. The bidder must provide a Tax and Customs Board statement; a foreign bidder must provide an equivalent certificate from a competent authority in its country. In a joint bid, the proof must be submitted for each joint bidder. The bidder must confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business register notification for electrical works covering the construction, including installation, of electrical installations. Foreign bidders may prove equivalent competence with an equivalent document. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value, excluding VAT. In a joint bid, this condition is met only if at least one joint bidder meets it alone; turnover may not be aggregated. The bidder must have the ability, by the contract date or within 10 calendar days after contract signature, to provide a performance security equal to 5% of the contract value. A bank or financial institution guarantee is accepted, as is depositing the corresponding amount in the contracting authority’s bank account or with a notary, provided the beneficiary remains the contracting authority throughout the construction period. Joint bidders may satisfy this requirement together. Within the 60 months before the start of the procurement procedure, the bidder must have completed at least 1 equivalent construction project as main contractor with a value of at least half of the estimated contract value excluding VAT. Equivalent work means construction, extension, or full-building reconstruction of a building as main contractor, including at least structural and external envelope works, forced ventilation with heat recovery, and heating system works. The bidder must provide the project name, building data, execution time and value, indicate whether it was new construction, extension or full reconstruction as main contractor, and confirm whether it included the required structural, ventilation and heating works. To prove completion, the bidder must provide either the number of the occupancy notice or occupancy permit in the building register, or a copy of the handover-acceptance act signed by the client and contractor. The bidder’s team must include a project manager with at least level 6 construction engineer qualification specialising in building construction and construction management competence, or level 6 construction manager qualification specialising in general building works. The bidder must provide the person’s name and professional certificate number. For foreign bidders, an equivalent qualification is accepted. The team must also include a site manager with at least level 5 construction site manager qualification specialising in general building works. The bidder must provide the person’s name and certificate number. For foreign bidders, an equivalent qualification is accepted. The team must include a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification with competences in managing heating system construction and ventilation system construction, or level 6 construction manager qualification specialising in indoor climate systems. The bidder must provide the person’s name and certificate number. For foreign bidders, an equivalent qualification is accepted. The team must include a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification with construction management competence, or level 6 construction manager qualification specialising in internal or associated water supply and sewerage systems. For electrical works, the team must include a person with at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations.
