Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Public Procurement Act section 95(1) points 1–3 and 5 apply, taking section 95(2) into account. The bidder must also confirm that it is not bankrupt or in liquidation, that no bankruptcy or liquidation proceedings have been opened against it, and that its business is not suspended or in a similar situation under the law of its country of establishment. In addition, the bidder must confirm that it has no tax, fee, environmental charge, tax debt or social security contribution debt under the law of its country of establishment. The bidder must confirm that its average wage level during the reference period was above 70% of the average wage for the same period in the relevant field, and must provide a Tax and Customs Board extract or an equivalent certificate from the competent authority in the country of establishment. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.
Qualification criteria and exclusion grounds
The bidder must have submitted a business activity notice in the construction field covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a business activity notice in the electrical works field for the construction, including installation, of electrical installations. For a foreign bidder, an equivalent certificate may be accepted instead of a register entry.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover may not be aggregated; the requirement must be met by at least one joint bidder on its own.
The bidder must provide details of at least one equivalent construction work, including the name of the work, the time and value of performance, whether it was the construction, extension or full reconstruction of a building as main contractor, and whether it included construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and the heating system. To prove performance, the bidder must provide the number of the occupancy notice or building permit in the building register, or a copy of the handover-acceptance certificate signed by the client and contractor.
The team must include a project manager with at least level 6 professional qualification as a building engineer specialising in building construction, or level 6 qualification as a construction manager specialising in general building works. There must also be a site manager with at least level 5 professional qualification as a construction work supervisor specialising in general construction works. In addition, the team must include a ventilation and heating systems specialist with at least level 6 qualification as a heating, ventilation and cooling engineer with the relevant management competences, or level 6 qualification as a construction manager specialising in indoor climate systems, and a water supply and sewerage systems specialist with at least level 6 qualification as a water supply and sewerage engineer or level 6 qualification as a construction manager with the relevant specialisation. For electrical works, the person involved must have at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The name and professional or competence certificate number of each such person must be provided. For a foreign bidder, equivalent competence may be used.
