Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, as well as committing a terrorist act or offences related to terrorist activity. The bidder or members of its management or supervisory bodies must not have been finally convicted of these offences within the last five years, or the disqualification period stated in the conviction must not still apply.
If needed, the bidder must confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Estonian Public Procurement Act. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted by law or the procurement documents.
Qualification criteria and exclusion grounds
The bidder must demonstrate economic and technical capacity. The machine-readable notice clearly stated that the net turnover for the last completed financial year must be at least EUR 160,000. Joint bidders may combine turnover figures. To prove turnover, the contracting authority may request an extract from the latest annual report or other evidence.
For technical and professional capacity, the bidder must submit a list of public road construction contracts completed within the 60 months preceding the start of the procurement. The contracting authority may also request a confirmation from the client that the works were performed properly. The exact scope of experience and any additional evidence must be checked in the tender documents.
For bid compliance, the bidder must submit the fully completed HD IV bill of quantities as an Excel file. The bidder may not change or delete the work descriptions, parameters, units of measure, quantities or other data provided by the contracting authority. The bidder must also complete the confirmations required by the contracting authority regarding the bid, business secrets, joint bidding, authorised persons and international sanctions.
