Compliance requirements

The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been initiated against it, if its business activity has been suspended, or if it is in a similar situation. Exclusion also applies if the bidder has unpaid state taxes, fees or environmental charges, or tax or social security contribution debts, unless the debt has been deferred or paid, or is paid or deferred within 10 calendar days after receiving the notice. The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). It must also confirm that its employees’ average wage during the reference period was not below 70% of the average wage in the relevant sector for the same period; this requirement does not apply if the bidder has no employees. A foreign bidder must provide equivalent certificates from a competent authority. The bidder and the technical consultant advising the apartment building reconstruction for the contracting authority must not be related persons. If the absence of exclusion grounds cannot be verified from public registers, the required evidence must be submitted within 10 calendar days.

Qualification criteria and exclusion grounds

The bidder must have filed a notice in the economic activities register under the construction activity category covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must have a notice in the register under the electrical works activity category covering construction, including installation, of electrical installations. The register entry requirement does not apply to a foreign bidder, but equivalent proof of competence must be provided where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT; the exact amount must be entered to the nearest 1 euro. The bidder must confirm that by the contract date, or within 10 calendar days after contract signature, it can provide a performance security confirmed by a credit or financial institution in the amount of 5% of the contract value, and that the security will remain valid throughout the construction period. As equivalent experience, the bidder must prove at least one similar construction project completed within the 60 months before the start of the procurement, with a value of at least half of the estimated contract value. The project must have involved the construction, extension or full-building reconstruction of buildings as the main contractor, including at least construction or reconstruction of load-bearing and external envelope structures, construction or reconstruction of a heat-recovery forced ventilation system, or construction or reconstruction of a new heating system. Evidence must include the project name, building details, execution period, value, and information on the nature of the works. If the bidder uses team members who are not its employees, written consent for their participation must be provided. In a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached.
