Compliance requirements

The bidder must confirm that no exclusion grounds apply: it is not bankrupt or in liquidation, no bankruptcy or liquidation proceedings have been initiated against it, and its business activity is not suspended. It must also have no tax, fee or environmental charge arrears, and no tax or social security contribution arrears, unless the debt has been deferred or paid within the required deadline. In addition, the bidder must confirm that none of the grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, that its employees’ average wage meets the required 70% threshold, and that it is not related to the technical consultant advising the apartment building reconstruction. If all confirmations cannot be checked from public registers, the relevant evidence must be submitted.

Qualification criteria and exclusion grounds

The bidder must be registered in the Economic Activities Register for construction activities covering general construction, indoor climate systems, and building water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to foreign bidders, but they must prove equivalent competence where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated value of the contract excluding VAT. The bidder must be able to provide a performance security amounting to 5% of the contract value by the contract signing date at the latest, or within 10 calendar days after signing; the security must remain valid throughout the construction period and may also be provided as a deposit to the contracting authority’s or a notary’s account. To demonstrate technical capability, the bidder must have completed at least one comparable construction project within the last 60 months, with a value of at least half of the estimated contract value excluding VAT. A comparable project must be the construction, extension or full-building reconstruction of a building as the main contractor and must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, mechanical ventilation with heat recovery, and a new heating system. The bidder must provide the project name, building details, execution period and value, and where applicable the handover certificate or building register data.
