Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1), points 1–5 of the Estonian Public Procurement Act apply. A foreign bidder must provide a criminal record certificate or an equivalent document showing the absence of the circumstances referred to in points 1–3, and a certificate from the competent authority showing the absence of the circumstances referred to in point 4. The contracting authority may also check any residence- or establishment-based participation restriction under national law if such a restriction is set out in the procurement documents.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. As compliance conditions, the bid must be submitted in the required structure, equivalence must be confirmed where relevant, and supporting evidence must be added if needed. The bidder must confirm that all fire safety services provided and fire safety installations supplied comply with the laws governing the field, and that it has the right to provide the requested services for the entire contract period; if an operating licence or economic activity notice is required, it must remain valid throughout the contract period.
