The bidder must confirm that neither the bidder nor members of its administrative, management or supervisory body, nor persons with representation powers, have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, use of child labour or other forms of human trafficking, or any other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder must provide the relevant explanations and, where applicable, evidence of self-cleaning measures. The compliance conditions also require confirmation that subcontractors or suppliers linked to the Russian Federation will not account for more than 10% of the contract value and that no subcontractor subject to replacement under Section 122(7) of the Estonian Public Procurement Act will be used in performance of the contract.

The bidder must have properly performed, within the 60 months preceding the start of the procurement, at least one public road construction contract that included surface dressing works covering at least 15,000 m². The contracting authority also accepts two surface dressing contracts, provided that each covered at least 7,500 m². The bidder must prove that the works were carried out properly. If any further qualification or suitability requirements are included in the tender documents, they must be checked there.
