Compliance requirements
The tender documents list the exclusion grounds in the ESPD. The bidder must confirm whether the bidder itself, or a member of its administrative, management or supervisory body, or a person authorised to represent, decide for, or control the bidder, has been finally convicted within the last five years for participation in a criminal organisation or corruption, or whether any exclusion period in the conviction still applies. If an exclusion ground exists, the bidder may provide evidence of self-cleaning. The machine-readable notice did not include the full list of exclusion grounds; the exact grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The qualification and exclusion conditions are set out in the ESPD, and the more detailed compliance requirements are in a separate document. The machine-readable notice did not include precise qualification, suitability or compliance requirements; these must be checked in the tender documents. The notice does state that information about the project manager must be provided if the project manager is not an employee of the bidder, a joint bidder, or the entity whose resources are relied on. The bidder must also confirm that it has inspected the site in person and that the bid is submitted unconditionally, accepting all tender document terms as they stand.
