Compliance requirements
The tender documents include standard exclusion grounds, including convictions for participation in a criminal organisation, corruption, fraud and other mandatory grounds under the Public Procurement Act. The bidder must confirm that none of these grounds apply to the company or to persons who manage, represent or control it. If an exclusion ground exists, the bidder may be asked to show self-cleaning measures. The machine-readable notice did not include the full list in a concise form; the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
At the bid submission deadline, the bidder must hold a valid public passenger transport operating licence for paid transport. If a foreign bidder does not hold such a licence, it must have the registration or operating authorisation required in its country of establishment and provide proof on the contracting authority’s request.
The bidder’s total turnover for the last three financial years ended by the start of the procurement procedure must be at least EUR 8,000,000. The bidder must be able to provide the last three annual accounts or other acceptable evidence if the accounts are not publicly available.
During the 36 months before the publication of the contract notice, the bidder must have performed route transport services totalling at least 4,000,000 route kilometres. To prove this, the bidder must submit a list of service contracts with information on value, dates, clients and other required details.
When submitting the bid, the bidder must complete the structure set out in the procurement documents and include the required forms, including the bid price form and the bid price calculation. In the case of a joint bid, powers of attorney and consents must be attached in the required forms. The bid must comply with all conditions set out in the procurement documents.
