Compliance requirements
The machine-readable notice lists exclusion grounds and bidder confirmations, but the precise control procedure and any additional details must be checked in the tender documents. The bidder must confirm that none of the exclusion grounds under Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt, in liquidation, under bankruptcy or liquidation proceedings, or otherwise suspended, that it has no tax, fee or social security debt under the law of its country of establishment, and that it is not a related person to the technical consultant advising the beneficiary on the apartment building reconstruction. The notice also requires confirmation that the bidder’s average wage during the reference period was above 70% of the average wage in the relevant sector, and proof from the Tax and Customs Board or an equivalent authority for foreign bidders. In a joint bid, each joint bidder is treated as a bidder and the proof must be provided for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for the activity of construction, covering general building construction, indoor climate systems, and water supply or sewerage systems within a building or connected to it. For electrical works, the bidder must have a registration notice for electrical works covering the construction, including installation, of an electrical installation. For a foreign bidder, the registration requirement does not apply, but equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated value of the contract, excluding VAT. The exact amount must be stated to the nearest euro.
The bidder must accept the condition that by the contract date, or within 10 calendar days after signing the contract, it must be able to provide a completion guarantee covering 5% of the contract value. The guarantee must remain valid throughout the construction period. A deposit of the corresponding amount into the beneficiary’s bank account or into a notary’s account is also acceptable, provided that the beneficiary remains the entitled party throughout the construction period. Joint bidders may satisfy this requirement together, but separate contracts are concluded for each housing association and a separate guarantee is required for each contract.
Within the 60 months before the publication of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the erection, extension or full-building reconstruction of a building as the main contractor, and it must include at least construction or reconstruction of the building’s load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a new heating system. For the project, the bidder must provide the project name, building details, execution period, value excluding VAT, and proof in the form of a use notice, occupancy permit or a handover-acceptance certificate.
The team must include a project manager with at least Level 6 construction engineer qualification specialising in building construction, or Level 6 construction manager qualification specialising in general building construction. There must also be a site manager with at least Level 5 construction foreman qualification specialising in general construction works. In addition, the team must include a ventilation and heating systems specialist with at least Level 6 heating, ventilation and cooling engineer qualification or Level 6 construction manager qualification specialising in indoor climate systems, and a water supply and sewerage systems specialist with at least the relevant Level 6 engineering qualification or Level 6 construction manager qualification. For electrical works, a person with at least a Class B competence certificate or Level 6 electrical engineer qualification in consumer electrical installations must be involved. The name and professional certificate number of each required person must be provided, and they must be involved in the performance of the works.
