Compliance requirements
The bidder must confirm that neither the bidder nor its management, representation or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, fraud, or offences related to committing a terrorist act. The bidder must also confirm the absence of any other exclusion grounds listed in the tender documents.
If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and any acceptable evidence must be checked in the tender documents if needed.
Qualification criteria and exclusion grounds
The bidder must demonstrate financial and technical capacity. The average net turnover for the last three completed financial years must be at least EUR 4,000,000. The bidder provides a confirmation in the ESPD, and the contracting authority may request an extract from the last three annual accounts or another document proving the turnover.
For technical and professional capacity, the bidder must have at least 1 properly completed road construction contract for a publicly accessible road within the 60 months before the start of the procurement, where at least 1,000 m² of top-layer asphalt surfacing was installed. The bidder must provide a short description of the contract, the performance period, the client details and, if needed, the reference number, and on request a client confirmation of proper performance.
The bid must comply with the tender documents, be submitted in the required price form and include all costs. If any other qualification, suitability or compliance requirements are not specified precisely, they must be checked in the tender documents.
