Compliance requirements
The bidder must confirm that neither the bidder nor the members of its management, administrative or supervisory bodies have, within the last five years, been finally convicted of participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of trafficking in human beings, fraud, or offences related to the commission of a terrorist act or terrorist activity, if the exclusion period is still in force.
If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures, where permitted. The contracting authority has also required a confirmation that no subcontractor will be used in performance of the contract if that subcontractor would have to be replaced under Section 122(7) of the Estonian Public Procurement Act.
The machine-readable notice did not include all precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must name a project manager and a site manager. Both must have at least a level 6 professional certificate as a construction manager or construction engineer, or an equivalent qualification, in the field of building construction or construction management.
The project manager must have, during the last five years (March 2021 to March 2026), managed construction works throughout the entire contract period in which at least two public buildings were built or reconstructed, and each building must have had a closed net floor area of at least 1000 m2.
The site manager must have, during the last five years (March 2021 to March 2026), acted as site manager throughout the entire contract period in at least two construction contracts in which at least two public buildings were built or reconstructed, and each building must have had a closed net floor area of at least 1000 m2.
The project manager and the site manager may be the same person, but in that case the person must meet the requirements set for the project manager.
The bidder must provide a confirmation for the references, including the role of the project manager or site manager in the reference contract, the name of the reference project, its value and the time when the construction works were carried out. If needed, digitally signed evidence signed by the client or contracting authority representative may also be submitted.
The bid must comply with the conditions set out in the tender documents and, where relevant, equivalent-solution explanations and evidence must be provided. If a joint bid is submitted, an authorised representative must be named. If the bid contains business secrets, this must be justified. The required bill of quantities and bid form must also be submitted.
