Compliance requirements
The bidder must not have the exclusion grounds listed in the Estonian Public Procurement Act § 95(1) points 1–5 and § 95(4) point 12. The bidder must confirm in the procurement register that these grounds do not apply. The bidder must also state whether there are any other persons in the company who are authorised to represent the bidder, make decisions on its behalf or control it, and who are not visible on the commercial register card; if so, the bidder must provide the authorised person’s name and personal identification code, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 400,000. If the bidder relies on the resources of another company, that company’s consent must be submitted and the relevant documents must be attached if needed. In the case of a joint bid, information on the size and nature of each joint bidder’s share of performance must be provided.
Within the 36 months before the start of the procurement, the bidder must have completed at least 2 contracts under which a data centre or data centres were rented. Each contract must have a value of at least EUR 100,000 excluding VAT. A list of those contracts must be submitted together with the contract values, signing dates and the other party’s contact details, as well as the procurement reference number where applicable. If a contract was performed only partly during the reference period, only the part delivered to and accepted by the client by that time counts.
The bidder must submit a technical description of the service showing compliance with the requirements, including the data centre location, the lengths of the communication links, the planned route description and a map. The bid must comply with the tender documents, and any equivalence must be supported by evidence. If a joint bid uses the resources of other joint bidders or another company, the required documents must be attached. The machine-readable notice did not include precise requirements; these must be checked in the tender documents.
