Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. If the bid is submitted together with a foreign company, the bidder must submit documents confirming the absence of exclusion grounds for that foreign company and for the persons who represent or control it. If the authority cannot verify the information from public registers, it may ask for additional documents. The machine-readable notice did not include more detailed exclusion grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last three completed financial years before the start of the procurement must total at least EUR 6,000,000, including at least EUR 2,000,000 in each financial year. If the bidder is not registered in Estonia or the data cannot be verified from public sources, the contracting authority may require extracts from annual reports or other evidence. The bidder may rely on the capabilities of another company, but then it must submit a signed confirmation from that company covering the absence of exclusion grounds, consent to reliance, and an explanation of how that company will participate in contract performance so that its experience can be used. For technical capacity, the bidder must have properly performed at least one construction contract within the last 60 months whose subject was the construction of a 110 kV substation, with a total contract value of at least EUR 1,500,000 excluding VAT. The contract may have started before the 60-month period and does not need to have ended by the tender notice date, but a 110 kV substation must have been built to the required extent. The contracting authority may request a client certificate or other proof. In addition, the bidder must submit the completed questionnaires “031A High-voltage equipment specification” and “041 Scope for relay protection and system automation”, the completed financing schedule, team CVs, and, where applicable, the bidder’s representative power of attorney and a foreign company’s commercial register extract or other document proving representation rights.
