Compliance requirements
The machine-readable notice states that the contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. If the bid is submitted together with a foreign company, the bidder must submit documents confirming the absence of exclusion grounds for that foreign company and for its board, supervisory board members and other persons entitled to represent it. If the contracting authority cannot verify the information from public registers, it may request additional documents. The exact exclusion grounds and required confirmations should be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 2,100,000 excluding VAT, with at least EUR 700,000 in each year. If the bidder is not a legal entity registered in Estonia, or if the contracting authority cannot verify the data from public sources, extracts from annual reports or other evidence must be submitted on request. Joint bidders may rely on each other’s figures. The bidder must have properly performed at least one contract for the construction or reconstruction of a substation with a voltage of 110 kV or higher within the 60 months preceding the publication of the contract notice; the contract value had to be at least EUR 295,000 excluding VAT. The contract could have started earlier, but the required works and design had to be completed and at least EUR 295,000 had to have been paid out during the period set by the contracting authority. For the reference contract, the bidder must provide the contract name or description, the client’s details, the contract period and the value. If the bidder relies on another entity’s capacities, a written commitment from that entity and an explanation of its role in contract performance must also be provided. The bid must include a completed price schedule, two technical questionnaires, a financing schedule and team CVs, and where applicable powers of attorney and documents proving the representation rights of a foreign company. The offered equipment must be new, unused, defect-free and comply with the technical requirements. The bid security is EUR 8,700.
