Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, and terrorist offences. If an exclusion ground applies, the bidder may, where allowed, provide evidence of self-cleaning. The machine-readable notice did not include the full list of exclusion grounds; the exact requirements must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the procurement must be at least EUR 1,200,000. Joint bidders may combine their turnover. To prove compliance, the contracting authority may request an extract from the latest annual report or other evidence; for a legal entity registered in Estonia, this may not be required if the data are publicly available.
The bidder must submit a list of contracts for public road construction works completed within the 60 months preceding the start of the procurement. The contracting authority may request confirmation from the client that the works were performed properly. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, where required, its consent and supporting evidence.
The bid must comply with the procurement documents, and where necessary an explanation of equivalence and evidence of equivalence must be provided. The bidder must complete the HD IV bill of quantities in full as an Excel file and may not change the provided lines, names, descriptions, parameters, units of measure or quantities. If this is a joint bid, separate ESPD documents must be submitted for all joint bidders. If the bidder has authorised persons whose details are not visible in the commercial register, their names and personal identification codes or a confirmation that no such persons exist must be provided. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
