Compliance requirements
The tender documents include mandatory exclusion grounds such as participation in a criminal organisation, corruption, fraud and other standard grounds. The bidder must confirm these grounds in the ESPD and, where applicable, provide details of convictions, dates, reasons, the person convicted, the exclusion period and any self-cleaning measures. The machine-readable notice did not include the full list of exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least one contract or order equivalent to the subject matter of the tender within the last 36 months. Equivalent experience means organising a course, training session and/or conference. As preliminary evidence, the bidder must confirm this in the ESPD, and the bid may include a list of the relevant contracts with their signing dates, value and the other contracting parties. If requested by the contracting authority, additional explanations, data or documents must be provided within five working days. The bid must comply with the tender documents and, where necessary, an explanation of equivalence and supporting evidence must be included. In the case of a joint bid, an authorised representative must be appointed. If the bidder does not use a subcontractor that would have to be replaced under Section 122(7) of the Public Procurement Act, this must be confirmed. The technical solution description must show how the bidder understands the scope of work, the team’s capability and the practical organisation. The machine-readable notice did not include precise additional qualification or compliance requirements; they must be checked in the tender documents.
