Compliance requirements
The bidder and the members of its administrative, management or supervisory bodies must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking. Other exclusion grounds under the Public Procurement Act may also apply.
If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, first-tier subcontractors are checked during contract performance and a problematic subcontractor may have to be replaced.

Qualification criteria and exclusion grounds
The bidder’s average annual turnover for the last three completed financial years must be at least EUR 800,000. The bidder must confirm compliance with the turnover requirement in the ESPD, and the contracting authority may request an extract from the last three annual accounts or another document proving turnover.
Within the 60 months before the start of the procurement, the bidder must have properly performed at least one contract for works on a public road, where at least 400 m² of top-layer asphalt surfacing or stone paving was installed and the work was carried out in an urban administrative unit. The bidder must provide a short description of the works, the performance period, the client representative’s contact details and any other required information in the ESPD.
