Compliance requirements

The contracting authority will exclude a bidder and will not sign the contract if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. If the bid is submitted together with a foreign company, the bidder must also submit documents proving the absence of exclusion grounds for that foreign company, including its management and supervisory board members and other persons entitled to represent it. If the contracting authority cannot verify the information from public registers, it may ask for additional documents.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least 2 gas pipeline external diagnostic service contracts during the 36 months preceding the start of the procurement procedure, covering a total gas pipeline length of at least 100 kilometres. The contracts may have started earlier, but the required diagnostic service must have been performed within the relevant period over at least 100 kilometres. If needed, the bidder must provide the client’s confirmation or other evidence, and the contracting authority may provide a form. If the bidder relies on the capacities of another entity, it must submit a signed confirmation from that entity stating that no exclusion grounds apply, that it agrees to the reliance, explaining its role in contract performance and confirming joint liability. When submitting the bid, the bidder must also confirm submission of the technical description, bid security in the amount of EUR 8,000, proof of authority or a power of attorney, a joint bidders’ power of attorney and confirmation where applicable, and, if relevant, registry or representation documents for a foreign company in the bid team or supporting entity. The bid must also confirm compliance with the technical description, trade secret declaration, equivalence and sanctions-related requirements, as applicable, and the submission of the required forms and evidence.
