Compliance requirements
The bidder must confirm the mandatory exclusion grounds in the tender documents, including convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The machine-readable notice does not provide the full list in a compact form, so the exact exclusion grounds and any self-cleaning details must be checked in the official tender documents. For some grounds, the bidder may be allowed to prove restored reliability if the conditions in the tender documents or law are met.
Qualification criteria and exclusion grounds
The bidder must show a net turnover of at least EUR 260,000 for each of the last three completed financial years before the start of the procurement. Joint bidders may combine their turnover figures. The successful bidder must provide an extract from the annual reports for the last three completed financial years, unless the information is already publicly available to the contracting authority from an official data register.
For technical and professional capacity, the bidder must have properly performed, as main contractor, at least 2 contracts completed within the last 60 months that are similar to the subject of this tender: construction of an asphalt-covered road, cycle path or parking area with an area of at least 1,000 m2. The contracts must have been completed correctly and in accordance with good practice. The bidder must list these contracts in the ESPD with information on the construction object, dates, contracting parties and other relevant details, and must be ready to provide client reference letters.
For the bid, the bidder must confirm compliance with the tender documents, that the bid price is submitted in the required structure, and that equivalence has been explained and supported by evidence where necessary. In the case of a joint bid, a power of attorney for the joint bidders must be attached. If subcontractors are used, the bidder must also comply with the sanctions requirement and confirm that no prohibited subcontractors or suppliers with Russian links are engaged for more than 10% of the contract value.
The machine-readable notice does not provide any more precise qualification or compliance requirements; these must be checked in the official tender documents and tender documents. The notice also contains exclusion-ground confirmations that must be completed in the official ESPD form.
