Compliance requirements
The machine-readable notice included exclusion grounds. The bidder is excluded if it is bankrupt or in liquidation, if bankruptcy or liquidation proceedings have been opened, if business activity has been suspended, or if it is in a similar situation under the law of its home country. The bidder is also excluded if it has unpaid state tax, fee or environmental charge debt, or tax or social security contribution debt under the law of its home country, unless the debt has been deferred, paid, or will be paid or deferred within 10 calendar days after receiving the notice. The bidder must also meet the mandatory confirmations under the Public Procurement Act: no exclusion grounds under § 95(1) points 1–3 and 5, taking into account § 95(2); the average salary of its employees must not be below 70% of the average salary in the relevant sector during the reference period; for foreign bidders, equivalent certificates from the home country are accepted; and the bidder must not be a related person to the technical consultant advising the apartment building reconstruction. If the bidder does not submit the required evidence and the absence of exclusion grounds cannot be checked from public registers, the bidder must provide the documents within 10 calendar days.
Qualification criteria and exclusion grounds
The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. For foreign bidders, the registration requirement does not apply, but equivalent proof of competence must be provided.
The bidder’s net turnover for the financial year preceding the submission of the bid must be at least equal to twice the estimated contract value excluding VAT. The exact amount must be stated to the nearest 1 euro.
The bidder must be able to provide a performance security confirmed by a credit or financial institution in the amount of 5% of the contract value. The security must remain valid throughout the construction period; depositing the corresponding amount into the beneficiary’s or a notary’s account is also accepted, provided that the beneficiary remains the entitled party throughout the construction period.
The bidder must prove that, within the last 60 months, it has carried out at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. An equivalent project means the construction, extension or full reconstruction of a building and must include at least the construction or reconstruction of the load-bearing structure and external envelope, the construction or reconstruction of a heat-recovery forced ventilation system, or the construction or reconstruction of a new heating system. The bidder must provide the project name, building details, period of performance, value and a description of the work.
The team must include: a project manager with at least level 6 construction engineer qualification or level 6 construction manager qualification; a site manager with at least level 5 construction site supervisor qualification; a ventilation and heating systems specialist with at least level 6 heating, ventilation and cooling engineer qualification or level 6 construction manager qualification with the relevant specialisation; a water supply and sewerage systems specialist with at least level 6 water supply and sewerage engineer qualification or level 6 construction manager qualification with the relevant specialisation; and, for electrical works, a person with at least a class B competence certificate or level 6 electrical engineer qualification in consumer electrical installations. If the bidder relies on the capacities of other persons, signed confirmations from those persons regarding participation in contract performance must be attached to the bid.
The tender documents also require confirmation that the bid is unconditional and complies with all tender document requirements, and that the joint bidders’ power of attorney is attached where applicable, together with the required bid price form and business secret declaration.
