Compliance requirements
The tender documents list mandatory exclusion grounds. The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons authorised to represent, decide for, or control the bidder, have been finally convicted in the last five years for offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, or other grounds listed in the official tender documents. If an exclusion ground applies, the bidder may be allowed to provide evidence of self-cleaning where the law or tender documents permit it. The machine-readable notice did not include the full list in a concise form, so the exact grounds must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder must have completed at least one similar contract within the 36 months before the publication date of the contract notice. A similar contract means a contract under which maintenance, dismantling or emergency repair work for gas extinguishing equipment or systems was performed. For completed contracts, the bidder must provide details in the ESPD: the contract partner, contact details, the contract period and, where applicable, the public procurement reference number. The contract does not have to be finished, but by the start of the procurement it must have been performed for at least 50% of its term. For performance of the framework agreement, at least 2 specialists must be involved: one with at least level 4 security systems technician qualification or equivalent competence, and another with level 5 responsible security systems specialist qualification or equivalent competence. For the gas extinguishing systems audit, at least one specialist with a fire safety specialist level 5 or higher competence certificate or equivalent competence must be involved. The bid must include valid professional certificates or other documents proving equivalent qualifications. The bid must be submitted by the bidder’s legal representative or an authorised representative. If the bid is submitted by another person, a power of attorney must be included, or, for a foreign bidder, proof of representation authority. In the case of a joint bid, a joint bidder power of attorney must be provided and an authorised representative must be named. The bid must comply with all conditions set out in the tender documents, and the price must be submitted according to the required structure and pricing form.
