Compliance requirements
The tender documents include the standard mandatory exclusion grounds, including criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour and other forms of human trafficking, terrorist offences, and other grounds under the Public Procurement Act. The bidder must confirm whether any of these grounds apply to the company, its management or supervisory bodies, or persons authorised to represent or control it. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning, where allowed by the tender documents or applicable law. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds and any required confirmations must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 1,900,000. Joint bidders may aggregate turnover. To prove turnover, the contracting authority may request an extract from the latest annual report or other evidence; if the data are publicly available in the Estonian Business Register, a separate proof may not be required. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, where required, its consent and evidence that it will be jointly liable for the part of the contract performed using its resources. For construction experience, the bidder must submit a list of public road construction contracts completed within the last 60 months that meet the contracting authority’s specified characteristics; the contracting authority may request a confirmation from the client that the works were performed properly. Under the compliance requirements, the bidder must submit the fully completed HD IV price list as an Excel file and confirm in the tender that it accepts all conditions set out in the contract notice and tender documents, submits a tender only for the matters requested, and will not involve a subcontractor that would be subject to replacement under Section 122(7) of the Public Procurement Act. If the bid is submitted jointly, a power of attorney and a separate ESPD for each joint bidder are required. The bidder may also need to provide details of authorised persons for checking exclusion grounds and confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
