Compliance requirements
The tender documents include the standard exclusion grounds from the Public Procurement Act, especially convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and other mandatory exclusion grounds. The bidder must confirm the required declarations and, where applicable, provide evidence of self-cleaning. The machine-readable notice did not include the full list in a concise form, so the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have experience in similar works: during the 60 months preceding the start of the procurement, it must have properly performed at least one public road construction contract that included gravel surface repair works in a total amount of at least 65,000 m². The contracting authority may request a confirmation from the client showing the scope, deadline and proper performance of the works.
If the bidder relies on the resources of another company, it must also submit a tenderer profile for that company and, if requested, the other company's consent confirming that the bidder relies on its capabilities and that the company will participate directly in contract performance to the extent relied upon.
For the project manager, the bidder must prove the right to manage road construction works under the laws of the country of residence. If the project manager does not reside in Estonia and does not hold at least a road engineer level 6 professional certificate in the sub-speciality of road construction and maintenance, a copy of the operating licence issued in the country of residence or another proof of that right must be submitted.
The bid price must also be submitted in euros according to the bill of quantities and the structure required in the register. In the case of a joint tender, a power of attorney is required, and the bidder must confirm that the tender complies with the tender documents. Conditional tenders are not allowed. Where equivalence is relied on, the bidder must explain it and provide supporting evidence.
